Terms of Service

These Terms govern access to websites, applications, AI services, APIs, developer tools, games (including Scrap Rush), and related services operated by ShuttleAI, Inc., a Delaware corporation (collectively, the “Services”). “ShuttleAI,” “we,” “us,” and “our” mean ShuttleAI, Inc.

By using the Services, you agree to these Terms to the extent a binding agreement can lawfully be formed. If you do not agree, do not use them. If you act for an organization, you represent that you are authorized to bind it. Our Privacy Policy explains how we handle personal information.

A product may have its own terms, privacy notice, order form, or enterprise agreement. Those more specific terms control for that product or subject if they conflict with these general Terms. Open-source software and third-party materials remain governed by their applicable licenses. These Terms do not replace more protective commitments in an existing agreement.

You must meet the minimum age and eligibility requirements of the product, your location, and any platform through which you access it. If you are under the age of legal adulthood, a parent or guardian must review and agree to these Terms where required. AI accounts, paid services, and developer accounts are not offered to children under 13; a product or platform may require a higher age.

Provide accurate registration information, protect your passwords and API keys, and promptly report suspected unauthorized access. You are responsible for activity you authorize and for safeguarding credentials under your control. Do not share access in a way that bypasses account restrictions or usage limits.

Subject to these Terms and any product terms, we grant you a limited, non-exclusive right to use the Services for their intended purposes. Commercial API use is permitted where the applicable plan allows it.

• Do not violate law, privacy, intellectual-property rights, or applicable platform rules.
• Do not exploit children, harass others, commit fraud, distribute malware, or use the Services to cause harm.
• Do not steal credentials, defeat security safeguards, disrupt infrastructure, bypass billing or rate limits, or access systems without authorization.
• Do not cheat, manipulate game rewards, or falsely represent an affiliation with ShuttleAI.
• Do not reverse engineer or copy proprietary Services except where applicable law or an applicable license permits it. Responsible security reports are welcome at the contact below.

You retain the rights you have in prompts, files, messages, and other content you submit. You must have the rights and permissions needed for us and the selected providers to process that content. You grant the limited rights necessary to host, transmit, process, display, and return it to provide, secure, support, and troubleshoot the Services and comply with law. This operational license does not itself authorize training on your private content; product-specific training terms and permissions apply.

AI can produce inaccurate, incomplete, offensive, insecure, or non-unique results. Review outputs before relying on them, running generated code, publishing them, or taking action. AI output is not a substitute for qualified medical, legal, financial, or other professional advice. Do not use it as the sole basis for decisions with significant effects on a person without appropriate human review and lawful safeguards.

Requests may be processed by outside model or infrastructure providers. Review the selected product’s privacy and routing information before submitting sensitive information. We do not guarantee that an output is copyrightable, exclusive, or free of third-party rights. Any ownership or usage rights remain subject to applicable law and model licenses.

Paid features are governed by the prices, billing method, renewal terms, and limits disclosed when you purchase or subscribe. You authorize the agreed charges and applicable taxes. Recurring billing or automatic refill applies only where you enroll in it; cancellation stops future renewals as described at checkout.

Unless a product’s terms or applicable law provide otherwise, completed usage charges and used credits are non-refundable. This does not remove mandatory cancellation, withdrawal, refund, or consumer rights. We may correct billing errors and investigate disputed transactions. Contact us promptly about a billing problem.

Service credits and game items are limited rights to use features, not bank deposits or investments. Game coins and rewards have no cash value and cannot be redeemed or transferred outside the game unless explicitly offered. Changes affecting purchased entitlements remain subject to applicable law and the terms of purchase.

Scrap Rush and other games are provided for entertainment. We may adjust balancing, levels, features, and rewards. Local progress may be lost when you clear browser data, change devices, uninstall a game, or experience a software failure; do not assume a cloud backup exists unless the game expressly provides one.

Platform availability depends on the relevant browser, device, app store, or distribution platform. Their own terms apply independently. A TikTok-distributed version, if available, must be used under TikTok’s eligibility and platform rules. No affiliation or endorsement is implied merely by distribution through a platform.

Except for your content and third-party materials, the Services, branding, and associated intellectual property belong to ShuttleAI or its licensors. No rights are transferred except those expressly granted. You may share ordinary gameplay screenshots and recordings, subject to third-party rights, privacy, and platform rules.

If you voluntarily provide suggestions, you allow us to use them to improve the Services without an obligation to pay you. This does not give us ownership of your unrelated work or permission to publish your personal information.

You may stop using the Services at any time. We may modify, suspend, or discontinue features, or restrict access for a material breach, nonpayment, security risk, abuse, legal requirement, or service discontinuation. Where practical and required by law, we will provide notice and an opportunity to address a problem or retrieve available data. Urgent protective action may be immediate.

Termination does not erase accrued payment obligations or legal rights. Provisions that are intended to survive, including ownership, applicable payment obligations, disclaimers, liability limits, and dispute provisions, continue to apply.

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted or error-free operation, particular results, output accuracy, compatibility with every device, or that all data can be recovered.

These disclaimers do not override an express contractual commitment, our data-protection obligations, or warranties and guarantees that cannot lawfully be excluded.

To the maximum extent permitted by law, ShuttleAI and its officers, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, business opportunities, goodwill, or data arising from the Services. Our aggregate liability arising out of or relating to these Terms or the affected Service is limited to the greater of US$100 or the amount you paid us for that Service in the 12 months before the event giving rise to the claim.

These limits apply regardless of the legal theory and even if a party was advised of the possibility of loss. They do not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where protected by law, or any other liability that cannot legally be excluded or limited. Your mandatory consumer and privacy rights remain intact. Where a limitation is not permitted, it applies only to the extent the law allows.

If you use a Service on behalf of a business, to the extent permitted by law, that business will indemnify ShuttleAI against third-party claims and reasonable resulting costs arising from its unlawful use, infringement by content it supplies, or material breach of these Terms. This does not cover a claim caused by ShuttleAI’s own breach, negligence, or misconduct. We will give prompt notice, reasonably cooperate, and not settle a claim imposing an obligation on you without your consent. This paragraph does not apply to individual consumers acting outside a business.

Delaware law governs these Terms, excluding its conflict-of-law rules. Disputes may be brought in the competent state or federal courts in Delaware, except where mandatory law gives you the right to use your local courts or requires a different law or forum. We encourage you to contact us first to resolve a concern; doing so is not a condition that prevents urgent relief or exercising a legal right.

If a provision is unenforceable, the remainder stays in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. We may transfer these Terms with a reorganization or transfer of the relevant business, without reducing your mandatory rights.

We may update these Terms prospectively and will publish the new effective date. Material changes will receive additional notice, and renewed agreement where required. Changes do not retroactively remove accrued rights or resolve an existing dispute in our favor.
